DO NOT BOOK YOUR FLIGHTS YET. Please wait until Fitness Vacation Exchange (FVE) sends you your official resort confirmation number. Your selected week is not considered fully confirmed by the resort until FVE receives and provides this confirmation to you. We strongly recommend that you do not purchase flights or make non-refundable travel arrangements before receiving your resort confirmation number.

Terms & Conditions

Please read the following terms and conditions carefully. By signing this agreement, you acknowledge that you have reviewed and accepted the terms applicable to your FVE teaching vacation.

FVE Booking Agreement

1. Purpose of Contract & Exchange

The parties agree to participate in a Fitness Vacation Exchange (“FVE”) teaching exchange.

FITNESS VACATION EXCHANGE will book the INSTRUCTOR and the companion included with the applicable reservation at the selected participating resort for an all-inclusive teaching vacation, subject to the fees, booking details, resort approval, and terms contained in this Agreement.

The INSTRUCTOR and included guest will receive lodging accommodations and applicable all-inclusive privileges in connection with the Exchange.

INSTRUCTOR agrees to teach two (2), one-hour fitness and/or wellness classes per teaching day, at the times and locations designated by the participating resort. Classes are not required on the scheduled arrival date unless otherwise agreed.

Resort staff shall determine class times and locations.

2. Contract Period

This Agreement applies to the specific teaching vacation identified in the Booking Details associated with this reservation.

The Contract Period begins on the listed check-in/effective date and ends on the listed check-out/termination date, subject to the cancellation, change, resort, and Exchange terms contained in this Agreement.

The applicable resort and dates are those displayed in the Booking Details and accepted by INSTRUCTOR when electronically signing this Agreement.

3. Standard Terms & Conditions

INSTRUCTOR agrees to provide two (2) fitness and/or wellness classes each teaching day during the Exchange, except that classes are not required on the arrival date unless otherwise agreed.

Each scheduled class shall run for approximately one (1) hour. Resort staff shall determine the applicable class times and locations.

INSTRUCTOR understands that class times and locations are established according to resort operational requirements and are not subject to unilateral modification by INSTRUCTOR.

INSTRUCTOR and their traveling companion(s) shall not discuss FVE fees, costs, or financial arrangements with resort personnel or resort guests.

INSTRUCTOR agrees to comply with all FVE program requirements, resort policies, professional standards, and the additional terms contained in this Agreement.

4. Administration Fee

The Administration Fee is a service fee charged by FITNESS VACATION EXCHANGE for services rendered, including but not limited to processing the booking, making the resort reservation, and completing follow-up with the INSTRUCTOR and resort prior to the Exchange.

The applicable Administration Fee and any Prime Season Fee or other applicable booking charges are presented as part of the specific booking.

All transactions are final upon receipt of fees, subject to the cancellation and change provisions contained in this Agreement.

International Transaction Fees & Currency Exchange

FITNESS VACATION EXCHANGE is not responsible for fees incurred due to international transactions, including bank fees, foreign exchange fees, or processing charges.

FVE does not assume responsibility for currency conversion rates at the time of payment or refund.

If a refund is issued, the amount received may differ from the original payment due to currency fluctuations or financial institution policies. INSTRUCTOR acknowledges and accepts these potential differences.

5. Resort Gift Fund

The Gift Fund Fee is a contribution toward a collective fund used to purchase gifts, equipment, supplies, or other requested items for participating resorts.

All applicable INSTRUCTORS are required to pay the Gift Fund Fee. Contributions may be pooled with those of other instructors and used to purchase items based on the individual needs and requests of the participating resort.

The applicable Gift Fund Fee is paid as part of the original FVE booking or invoice and does not need to be paid again for the same booking.

Rare Gift Delivery Situations

In rare situations, INSTRUCTOR may be asked to bring an item requested by the resort.

FVE may purchase the applicable item and send it to INSTRUCTOR's address. INSTRUCTOR will then be responsible for bringing the item to the resort.

Where applicable, gift items should be carried within the INSTRUCTOR's carry-on baggage when practical.

The Gift Fund Fee covers the applicable gift item and does not include additional travel expenses such as checked baggage fees. Any additional baggage fees incurred by INSTRUCTOR are the responsibility of INSTRUCTOR.

FVE will notify INSTRUCTOR in advance when this arrangement is required.

6. Cancellation & Booking Changes

FITNESS VACATION EXCHANGE encourages INSTRUCTOR to be confident when selecting travel dates and locations. If INSTRUCTOR cannot travel or needs to change dates, INSTRUCTOR must contact FITNESS VACATION EXCHANGE immediately so another instructor may be located for the vacated session.

Cancellation & Change Fee Policy

If INSTRUCTOR cancels the reservation within sixty (60) days before the scheduled departure date, no refund will be issued and cancellation is not permitted under the standard policy.

If cancellation or a booking change occurs outside the sixty (60) day window before the confirmed departure date, a $200 USD Cancellation or Change Fee will apply.

All changes remain subject to resort availability and approval.

Changes to Travel Companions

Any modification to the listed travel companion associated with the reservation will incur a $75 USD fee per change.

This non-refundable fee applies to each request to amend or substitute a travel companion, including name changes and guest replacements.

Payment of the applicable fee is required before the requested companion change will be processed.

7. Indemnity & Liability

INSTRUCTOR agrees to release, indemnify, defend, and hold harmless FITNESS VACATION EXCHANGE, FitStay, their respective owners, officers, employees, contractors, affiliates, partners, participating resorts, resort partners, representatives, and other applicable Released Parties from claims, demands, liabilities, suits, judgments, damages, losses, or expenses arising out of or relating to participation in the Exchange, to the fullest extent permitted by applicable law.

Acknowledgment & Assumption of Risk

INSTRUCTOR acknowledges that participation in fitness, wellness, and recreational activities—including group fitness, strength training, aquatic fitness, yoga, mobility, and related instruction—involves inherent risks.

These risks may include physical injury, musculoskeletal injuries, slips, falls, accidents, equipment-related injuries, illness, dehydration, and unforeseen medical events.

Activities may occur in international resort environments involving additional risks, including unfamiliar facilities, climate conditions, varying safety standards, transportation, local conditions, and access to medical care.

INSTRUCTOR voluntarily and knowingly assumes the known and unknown risks associated with participation.

Participation Status

INSTRUCTOR participates in the FVE program voluntarily as part of an exchange-based experience.

INSTRUCTOR acknowledges that they are not an employee of FITNESS VACATION EXCHANGE, are not entitled to wages, salary, insurance, or employee benefits, and participate in exchange for access to accommodations and experience-based benefits.

Nothing in this Agreement creates an employment, partnership, joint venture, or independent contractor relationship.

Release & Waiver of Liability

To the fullest extent permitted by law, INSTRUCTOR releases and discharges the Released Parties from claims, liabilities, demands, or causes of action arising from or relating to personal injury, illness, death, property damage, loss, theft, accidents during travel or the resort stay, or participation in or facilitation of fitness and wellness activities.

This release includes claims arising from ordinary negligence of the Released Parties to the extent permitted by applicable law.

Medical Responsibility

INSTRUCTOR certifies that they are physically fit and able to safely participate in and/or lead applicable fitness and wellness activities.

INSTRUCTOR assumes responsibility for medical expenses and is solely responsible for obtaining and maintaining appropriate health, accident, and/or travel insurance.

INSTRUCTOR authorizes FVE and/or resort personnel to obtain emergency medical treatment if reasonably necessary and accepts responsibility for associated costs.

Indemnification

INSTRUCTOR agrees to indemnify, defend, and hold harmless the Released Parties from claims, damages, losses, liabilities, or expenses, including legal fees, arising from INSTRUCTOR's actions or conduct, activities led or participated in by INSTRUCTOR, or breach of this Agreement.

8. Instructor Information & Certifications

All information provided by INSTRUCTOR concerning qualifications, experience, professional specialties, certifications, and other professional information is represented by INSTRUCTOR as correct and current.

INSTRUCTOR acknowledges that FITNESS VACATION EXCHANGE and its partners, vendors, agents, representatives, and participating resorts may rely upon this information.

Inaccurate information, whether intentional or not, may disqualify INSTRUCTOR from future participation in the FITNESS VACATION EXCHANGE teaching exchange program.

FVE works exclusively with certified fitness and wellness professionals as applicable to the classes being offered.

INSTRUCTOR must provide proof of current required certification before final confirmation when requested.

If required proof of certification cannot be provided, fees paid to FITNESS VACATION EXCHANGE for the applicable teaching vacation may be forfeited and no refund provided.

Video Submission

A participating resort may request a video of INSTRUCTOR teaching a class for review. This allows the resort to evaluate teaching approach, energy, and participant engagement.

Although a video may not always be required, FVE recommends that INSTRUCTOR maintain a recent 20–30 minute teaching video for potential resort review and approval.

9. Code of Conduct & Instructor Expectations Instructor Expectations

INSTRUCTORS are ambassadors of FITNESS VACATION EXCHANGE and are expected to represent FVE professionally.

INSTRUCTOR and accompanying guest(s) must conduct themselves professionally when interacting with resort managers, staff, and guests.

Problems, discrepancies, or concerns that arise during the Exchange, regardless of size, must be brought to the attention of FITNESS VACATION EXCHANGE rather than being disputed directly with resort management, staff, or guests.

Instructor Expectations

Enthusiasm: Resorts expect smiling, motivated, professional instructors who interact positively with guests and provide fun, effective, and safe programming.

Punctuality: INSTRUCTOR should arrive approximately 20 minutes before each class to address sound-system concerns and interact with guests. If no participants initially attend, INSTRUCTOR must remain available for at least 20 minutes. The minimum class size is one participant.

Performance: INSTRUCTOR understands that professional image, expertise, energy, and teaching ability may be evaluated by resort management and guests.

Appearance: INSTRUCTOR must dress professionally and appropriately for fitness/wellness instruction during class or gym time.

Conduct: INSTRUCTOR and accompanying guest(s) must behave courteously and professionally during both teaching and leisure portions of the Exchange.

Safety: INSTRUCTOR must remain aware of guest abilities and limitations, particularly considering heat, humidity, sun exposure, dehydration, alcohol consumption, and other conditions that may affect safe exercise intensity.

Resort Staff: INSTRUCTOR must follow applicable directions provided by resort staff.

Resort Guests: INSTRUCTOR is expected to engage with resort guests and appropriately promote scheduled classes.

Tipping: INSTRUCTOR and guests should follow applicable resort policies regarding tipping.

Professional Behavior

INSTRUCTOR may not consume alcohol before teaching scheduled classes.

INSTRUCTOR and accompanying guest(s) must avoid public intoxication or other unprofessional conduct.

Reports of public intoxication, missed classes, inappropriate behavior, unnecessary demands on resort staff, or other serious professional misconduct may result in termination of participation, removal from the resort, being charged the applicable full retail cost of the stay, and/or loss of eligibility for future FVE participation.

10. Reviews, Social Media & Guest Engagement

INSTRUCTOR and their guest(s) are required under the current FVE program terms to post a positive 5-star TripAdvisor review within five (5) days after returning from the FVE teaching vacation and provide the associated review link to FITNESS VACATION EXCHANGE.

As part of participation with FITNESS VACATION EXCHANGE, INSTRUCTOR agrees to:

  1. Make four (4) posts per week on Facebook or Instagram showcasing classes and the FVE experience.
  2. Share one (1) story daily on Instagram or Facebook highlighting the FVE experience.
  3. Participate in the FVE community/group by joining discussions and sharing content.

  5. Create one to two (1–2) videos per week showcasing classes, resort amenities, and/or the FVE experience and tag FVE.
  6. Include #FitnessVacationExchange and #TeachandTravel in applicable posts.
  7. Include #FitnessVacationExchange and #TeachandTravel in applicable stories and videos to support FVE visibility and branding.

Posting more than the minimum requirements is appreciated.

Guest Engagement & Survey Mention

INSTRUCTOR agrees to actively engage with program participants and resort guests attending their classes and encourage them to leave reviews.

INSTRUCTOR should encourage participating guests to mention the INSTRUCTOR's name in applicable resort survey responses.

11. Travel Guidelines

Customs & Immigration Forms

When completing customs or immigration documentation, INSTRUCTOR is responsible for providing truthful and legally appropriate information concerning the purpose of travel and complying with all applicable immigration and entry requirements.

Important: Your source contract specifically instructs instructors to designate “vacation” or “pleasure” rather than “business.” Because immigration declarations must be truthful and requirements vary by country, I recommend FVE obtain legal review before putting that instruction into the automated binding agreement. I have therefore not silently copied that instruction as a contractual requirement.

Passport & Entry Requirements

INSTRUCTOR and guest(s) are responsible for maintaining valid passports and satisfying applicable destination entry requirements.

The source FVE contract requires passports not to expire earlier than six months following the return from the Exchange. Visa or other entry requirements may also apply depending upon nationality and destination.

Inclement Weather Airport Transfers

If a flight is canceled or a participating resort is closed because of weather at the time of the scheduled trip, INSTRUCTOR may roll over the applicable booking fee to another date, to be used within a 60-day period, subject to the FVE Inclement Weather Policy.

Travel Insurance

FITNESS VACATION EXCHANGE highly recommends that INSTRUCTOR obtain appropriate travel insurance.

Airport Transfers Lost Items

Transportation to and from the airport is the responsibility of INSTRUCTOR unless FVE specifically advises that transportation will be provided by the participating resort or another arrangement applies.

Lost Items Flights

FITNESS VACATION EXCHANGE is not responsible for lost or stolen personal property, currency, guest property, or gift items during travel.

This includes losses occurring at airports, during transfers, at resorts, or at other locations visited during the Exchange.

INSTRUCTOR and guest(s) are responsible for keeping valuables in secure locations.

Flights

INSTRUCTOR must wait to receive booking confirmation from the participating resort through FITNESS VACATION EXCHANGE before booking flights to the requested destination.

12. Pregnancy Policy

For safety and liability reasons, INSTRUCTORS who are more than three (3) months pregnant at the time of travel are not eligible to participate in a teaching vacation under the current FVE policy.

This policy is intended to protect the health and well-being of the instructor and unborn child because travel and teaching physical fitness classes may involve increased risks during later stages of pregnancy.

INSTRUCTOR is encouraged to disclose relevant circumstances in advance to FITNESS VACATION EXCHANGE so appropriate arrangements can be considered.

13. Resort & Exchange Changes

Rare Resort Capacity Occurrences Exchange Changes

There is a possibility that a participating resort may reach full capacity while hosting an INSTRUCTOR.

In such circumstances, INSTRUCTOR may be moved temporarily to alternative accommodations off the resort property.

Transportation will be provided when needed, and applicable resort activities and amenities will remain available to INSTRUCTOR and guest(s).

If INSTRUCTOR is requested to move to alternative accommodations for one or more nights because of resort capacity, cooperation with the arrangement is required.

Exchange Changes

A booked Exchange remains subject to venue changes or cancellation.

If such an event occurs, FITNESS VACATION EXCHANGE will attempt to place INSTRUCTOR in another available Exchange.

INSTRUCTOR agrees, to the extent permitted by applicable law, to hold harmless FITNESS VACATION EXCHANGE and its partners for changes or cancellations resulting from weather conditions, civil unrest, closures, acts of God, or other circumstances outside their reasonable control.

14. Governing Law

The provisions of this Agreement shall be governed by the laws of the State of Colorado, United States of America, unless otherwise required by applicable law.

If any provision of the incorporated Liability Waiver or this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect to the extent permitted by applicable law.
